COURT OF BANKRUPTCY, PETERSFIELD.
TUESDAY.—Before C. J. Mellersh, Esq., Registrar.
IN RE C. W. GARNER
This was the day appointed for the first examination of Charles William Garner, late of' Lucknow-street, Fratton, baker and grocer, and now of the Railway Tavern, Liss, licensed victualler. In answer to the registrar, bankrupt said that he had been in business on his own account for two years and a half. In July last he compounded with his creditors, paying them 6s. in the pound. At the time he commenced business he had a capital of 70l. He now owed unsecured creditors 109l. 7s. 2d. In March last he mortgaged his interest in his late father’s will to Mr. Hall, brewer, of Alton, securiing 100l. He had made an assignment of his furniture and effects to Mr. W. S. Hawgood, of Landport, securing 26l. His furniture and effects had been sold by order of the court, for 12l. 15s. He had good debts owing to him amounting to 15l. He had not taken any account of his affairs until he petitioned that court. At the time of his bankruptcy he had 13s. in cash. His life was insured for 100l. in the European Life Office. The insurance was effected in 1861. The policy of insurance was In the hands of Messrs. Hoskins and Son, solicitors, of Gosport. They had no lien thereon. He estimated his Interest under his father’s will to be worth 200l., and after paying the incumbrances thereon, would leave a surplus of 70l. for his creditors. The causes of his bankruptcy were his having been called upon to pay Mr. Knight, of Southampton, the amount of his debt, after having paid him through the agency of Messrs. Edmonds and Hatch, of' Portsea, accountants, the composition of 6s. in the pound in discharge of' his claim; also the law expenses attending the trial of the action, when Mr. Knight repudiated the agency of Messrs. Edmonds and Hatch; also the insufficiency of his profits to meet necessary expenditure.
Mr. Crafts, of Petersfield, spirit merchant, and Mr. Godden, of Midhurst, wine and spirit merchant, respectively proved their debts of' 18l. 16s. 2d. amid 12l. 18s. 10d.
The bankrupt, having answered the usual questions, passed his first examination, supported by Mr. Paffard, of Portsea, and the 18th of July was fixed for his final hearing.
