     Highway Case.—Butler v. the Parish of Greatham.—In this case Mr. Walter Butler, of Bradshott, charged the Waywarden (Mr. William Goodeve), with neglecting to repair a certain road in the above parish. Mr. Albery, of Midhurst, appeared for complainant. The road in question is about 1800 yards in length, leading from the Petersfield and Farnham turnpike-road to a place called Woodend. Mr. Albery called Edward Bicknell, who deposed—I live at Woodend Cottage, have lived there for 16 years and upwards; during that time the road mentioned in the information has been used as a public highway. I have used it myself, it leads into the road from Empshott to Headley; have never been interrupted in using it; have known it for more than 20 years, and all that time has been used as a public road; it is very much out of repair, it is in better condition near Mr. Goodeve's house than it is further down, some parts are so bad you cannot get along on foot. Defendant pleaded non-liability as to about two-thirds of the distance laid in the information, and that portion for which the parish was liable was in good and efficient repair. The Chairman stated that the Bench had no jurisdiction to that portion to which defendant pleaded non-liability. The decision respecting the other portion was adjourned to the 8th March, and in the meantime two Magistrates will make a survey of the same.
